Yes, I know I said that paying for a solicitor to represent you isn't necessary; however, if you are going down the section 8 route, it will lead to a court hearing. As a litigant in person, you can represent yourself; many do, but many Claimants find courts intimidating, especially when a tenant has the duty solicitor on their side. The same applies if there is a hearing for a section 21, as despite our best efforts, not all judges follow the rules, and perhaps more concerning, not all judges seem to know the rules! |
Once the Solicitor is provided with all the court papers and statements, they turn up on the day and represent you. Most hearings are scheduled for between 10 and 20 minutes, a few words may be exchanged, and in 99.9% of cases, possession will be granted. It will have cost you £300.00 - it's a good job you did not hire them from start to finish! |
